Zoloft Lawsuit

March 30th, 2012 | Posted by Admin in Zoloft Class Action Lawsuit - (Comments Off)

Zoloft is used for treating depression and certain anxiety disorders.  Unfortunately, this SSRI drug and others have been linked to birth defects in babies born to women who took the drug during pregnancy.  Many of these women have  initiated a Zoloft lawsuit and are seeking compensation.

Zoloft is a soft blue oval-shaped pill and the generic name is sertraline hydrochloride.  It produces a dopamine action that helps clinically depressed people get back into the swing of daily life.

There are also some Zoloft off label uses.  These are eating disorders, Generalized Anxiety Disorder and menopause symptoms.  If there is Bipolar disorder then Zoloft is not supposed to be taken.  This is the second strongest SSRI on the US market right now, so Zoloft side effects are not to be taken lightly.  The Zoloft lawsuit involves very serious side effects including heart problems in babies.

The newest Zoloft class action lawsuit hit the news this week, with a group of parents in Illinois suing Pfizer.  Pfizer makes the antidepressant, which is classified as an SSRI.  SSRI’s have had a black box warning on them since 2007, when the FDA required the strongest warning possible on all SSRI antidepressants.

A black box warning is the FDA’s strongest warning for a drug that can still remain on the market.  The Zoloft class action lawsuit plaintiffs are suing over Zoloft birth defects found in babies whose mothers took the antidepressant while pregnant.  Female plaintiffs were prescribed Zoloft during pregnancy and all had babies with severe birth defects, including heart problems.

The Zoloft class action refers to several studies published in medical journals showing a doubled risk of serious heart-related birth defects in babies born to mothers who took Zoloft and other antidepressants.

Pfizer is accused of fraud, misrepresentation, negligence, and breach of implied warranties, as well of violations of various Consumer Protection Laws.  Plaintiffs are suing for compensatory damages, actual damages, court costs, and a disgorgement of profits.
